Commercial License Terms
Commercial License Information:
Unlimited Small Business Commercial Use for general handmade products such as cups, shirts, tote bags, hats, wood signs, etc. We consider a small business to be a business with 10 employees or less...covered under the terms below. If you have any questions about products allowed not mentioned in these terms please email firstname.lastname@example.org. Personal Use is Always allowed. We strive to answer all emails within 72 business hours after receipt of email.
You MAY NOT use ANY of my file/design packs including clip art print-on-demand sites or large commercial sites like Amazon, JET, Wayfair, Zulily, Zazzle, CafePress, TeeFury, Printful, Society6, Spoonflower, RedBubble etc etc etc.You MAY NOT under any circumstances sell any digital goods in direct competition with me made from any Scout and Rose Designs or any Scout and Rose Design Elements unless you digitize embroidery and have purchased an extended license (See Below). For example you may make Physical Planner sticker sheets that you print and cut and sell to your customers but you can not offer Planner stickers in the form of a digital product downloads. Commercial License only covers Physical End Products.
You MAY NOT use our files to sell sublimation, water slide decals, craft iron on and HTV transfers unless you purchase an extended license (Plastisol Screen Print Transfers are not covered under this license). License will be available again for purchase at the end of October 2019 at the price of 89.99 for non-members and 39.99 for lifetime members and will include unlimited prints.
If you previously purchased our license when we initially offered it you are covered under the price you paid and will not be required to make an additional purchase.
*Please note* Scout & Rose Design Co. does sell Ready to Press Sublimation transfers of our own designs but, this does not limit you on selling through your own business lines.
Starting the end of October 2019 I will release several items a month that I will not offer as Sublimation Transfers on my own to let you that have purchased the license have some sort of exclusivity and are not always competing with me as a business owner.
Absolutely NO SELLING of Screen Print Transfers (Plastisol Transfers) ever with any of my designs or design elements. Scout and Rose Design Co. reserves the sole right to use of my own designs as Screen Print (Plastisol Transfers) with no competition.
Absolutely NO SELLING of Patterned Vinyl Sheets ever made with any of my designs or design elements. This is referring to those that have a set up to Print HTV and Permanent Vinyl Sheets and resell to customers to cut on their die cutters at home. Scout and Rose Design Co. reserves the sole right to use of my own designs to create the above mentioned with no competition if we ever see this product line as a fit for our business.
IF you have your own Sublimation Printer Set Up: Other than what is mentioned above regarding the selling of Printed Ready to Press Sublimation Transfers....you are allowed to purchase and/or download designs from our Scout and Rose Printables section and make unlimited handmade physical end products such as shirts, garden flags, coasters, clip boards, shirts etc. You are allowed to change the color of a design, add your own elements to, add your own text to, and even piece together designs to suit your business needs. However these terms are limited to PHYSICAL PRODUCTS ONLY and you MAY NOT EVER sell anything you create as a digital product.
Regarding Mock Ups and Watermarks:
You MAY NOT use any of my product photos to gauge interest on your business pages and shops. Most mock ups that I have used up until October 2019 have been purchased from Mock Up Photographers and my personal License purchased only covers my business use. If you use them you are in direct violation of the Mock Up Photographers TOU. If you are interested in the look of my product photos I purchased all of them on ETSY.
You MAY use any Mock Ups created by me to advertise your designs on your business pages and shops. However when using my Mock Ups + My Designs hand in hand you are expected to make sure to watermark your image so my creative property is not stolen by other people. If they are available to use they will be in our Mock Ups Section.
Regarding Fonts Used in My Designs:
Due to the amount of money & time invested in picking and purchasing fonts I choose not to give out font information used in my designs.
However you can locate the font on your own or use another font of your choice and modify text on any of my designs to suit your business needs. Altering the Text or Font on a design DOES NOT allow you to sell a modified design that you create digitally.
I do my best to keep up-to-date with any Registered Trademarks before creating any designs! Because of excessive new trademarks being applied for and registered daily + the types of products a trademark is limited to, I can not guarantee that any phrases on my designs will not be a registered trademark.
It is your responsibility and smart business practice as a small business owner to research the USPTO database to make sure your products do not infringe on a registered trademark. By purchasing or downloading any design or membership by Scout and Rose Design Co. you agree that you are responsible for your own business and Scout and Rose LLC will not be held liable with regards to trademarked phrases. You can always check the trademark database at www.uspto.gov
If it is discovered that one of our designs contains a trademarked phrase or we are notified that one of our designs is a registered trademark across ALL products you could possibly sell we will promptly correct the issue as soon as possible by either 1. removing text from our design and keeping the clip art or 2. removing the design completely if there is not any remaining clip art to display and discontinue the listing. We will also remove the item in question from any of our back up Cloud Storage Systems members may have access to. However if a design is registered as a trademark for shirts but not tote bags or other products the design will remain.

Due to the nature of our digital products we do not issue refunds. It is up to you to know what files are compatible with your software and know how to use your software/computer/device/machine. However, We want to make sure that you are satisfied with your purchase! If you have any problems you can send us a message for customer service and we will be happy to fix any issues you may have!
